This privacy statement describes how we use data relating to anyone who registers with us to be a buyer or prospective buyer (“you”) or prospective buyer (“you”) at an auction managed by us (“Auction”). “We” or “us” are Wyles Hardy & Co Limited, a company which is registered in England with registered number 2598566 and whose registered office is at 9 Bonhill Street, London, EC2A 4DJ, England.
Your privacy is very important to you and us. We depend on your trust. We comply with the Data Protection Act 2018 as amended on 25th May 2018 to include the General Data Protection Regulations (EU)2016/679 and only use your name and other data relation to you in the manner set out in our Privacy Policy. We only use your personal data in a way that is fair to you. We only keep your information for as long as we need to for legal requirements or as is relevant for the purposes for which it was collected.
What is personal data?
Personal data is any information which relates to a living person, from which they can be identified. Sensitive personal data is defined as information about racial or ethnic origins; political opinions; religious beliefs or other beliefs; trade union membership; physical or mental health; sexual life; criminal allegations, proceedings or convictions.

Collecting your data
Wyles Hardy and Co collect the following data about you when you apply to register for eligibility as a buyer at an Auction and whenever you provide updated details to us. We may obtain further information from you for security purposes in order to verify your identity. We also allocate usernames, passwords and paddle numbers for you and issue replacements usernames and passwords and paddle numbers.
Processing your data
Data processing encompasses the collection and use of personal data. The Company will process your personal data in order to allow you access to the areas of our Auction services. The Company will also use your personal data in order to perform pastoral, statutory and administrative purposes and responsibilities to you and others.
Examples of processing for these purposes include, but are not limited to: processing information about your relationship with the Company, processing information to enable you to use the Company’s facilities and to allow effective communication with you, processing information to survey you or to conduct research and processing information to fulfil our statutory responsibilities.
Sharing of personal data
In the fulfilment of the Company’s responsibilities and purposes, personal data collected by Wyles Hardy and Co may be shared within the Company and any of its subsidiaries. We do not sell or transfer your personal data to third parties except as set out in this privacy policy or as you otherwise consent.
The Company will disclose your data to third parties where necessary to provide the Auction service (whether in an auction room, on the telephone, electronically or by any other means), for example; to third parties with whom we jointly provide an auction with. We may also pass on your details to a vendor who is selling a product for which you have placed a bid or to financial organisations for processing your payment card details for payment.
In addition, the Company may disclose your personal data to other bodies (i.e. its clients) outside of the Company in order to fulfil these responsibilities and purposes. Such bodies include but are not limited to:
- Any financial links/funders/sponsors
- Providers of external training or placements
- Employers or prospective employers and other educational institutions
- Any relevant professional or statutory regulatory bodies
- Any relevant public bodies, including but not limited to the UK Home Office, HM Revenue and Customs and Local Authorities
- Organisations that provide specific services on behalf of the Company including but not limited to: mailing houses, organisations providing external administration services and auction services.
Other than as set out in this Privacy Policy, we shall not disclose your personal data to third parties without obtaining your prior consent unless this is necessary to provide our Auction service or unless we are required to do so by law.
Other countries
Your data may be accessed in other countries for the purposes described in this Privacy Policy. Some countries in the world may not have adequate data protection laws or may offer differing levels of protection of personal data which are not as high as in the UK and European Economic Area.
Subject access requests
The Data Protection Act 2018 gives you the right of access of your personal data subject to certain exemptions.
